TheyOkay Terms of Use
TheyOkay is an app for staying in touch with your loved ones. It is not a medical device and not an emergency service. We do not guarantee that messages, notifications or alerts will be delivered on time or at all. If someone is unwell, call your local emergency number: 911 in the US, 112 in Europe, 101 in Israel.
1. Who we are and what these terms cover
The TheyOkay app (the "app" or the "service") is provided by [full name or company name, country of registration, number] ("we", "us"). Contact: simpltools.apps@gmail.com.
These terms are an agreement between you and us. By installing the app and ticking "I accept the Terms of Use", you agree to them. If you do not agree, do not use the app.
2. What the service does
TheyOkay helps a family stay in touch with an older person through their ordinary phone:
- voice messages, stickers and an "I'm okay" check-in;
- information about the older person's phone — battery, when the phone was picked up, whether it is online;
- "Listen in" to what is happening nearby, and the phone's location at that moment — only with the person's consent and with a visible and audible warning on their phone.
The service is first of all a convenient way to communicate. Phone information is a hint for the family, not an assessment of the person's health or safety.
3. What the service does not do
- It is not a tracker. The app does not track location continuously and does not keep a location history. Location is determined once, on request and with the person's consent, and is deleted within 48 hours.
- It is not a medical device. The app does not measure health indicators, make diagnoses, or replace a doctor, caregiver, medical monitoring or an emergency call button.
- It is not an emergency service. We do not call an ambulance, the police or anyone else, and we do not monitor alerts around the clock. You always decide what to do.
- We are not a telecom operator. The app depends on things we do not control: the phone and its battery, Android settings and restrictions, the mobile network and internet, Google services (including Firebase and notifications), and the Google Play store.
4. No availability guarantee
We work to keep the service reliable, but provide it "as is" and "as available". We do not guarantee that:
- the service will run without interruptions, errors or delays;
- voice messages, stickers, notifications and alerts (including "Offline", "Phone not used for a while", "Battery low") will be delivered, delivered on time, or be accurate;
- an "All good" status means the person is actually fine, or that its absence means something has happened.
Do not rely on the app as the only way to know that your loved one is okay.
5. Consent and fair use
- You may connect a person's phone only with their consent. They give it themselves on their phone and can withdraw it by uninstalling the app.
- You may not use the service for covert surveillance, stalking, or controlling a person against their will. The app is designed so that the microphone and location are used only with a warning on the older person's phone.
- You are responsible for what you record and send: voice messages and stickers must not break the law or infringe the rights of others.
- Do not try to bypass the service's security, access other people's data, or disrupt the service.
6. Making it work better
For the app to work as well as possible, keep the older person's phone charged, do not revoke the permissions it was given, and do not restrict the app with battery optimisation. Section 4 still applies.
7. Account and family
- You must be at least 16 to use the service, and 18 (or have parental consent) to subscribe.
- You sign in with a Google account and are responsible for access to it.
- The person who creates a family is its admin. Admins can invite and remove members, connect and disconnect phones, and change settings. A family can have several admins.
- We may restrict or end access if the service is used in breach of these terms or the law.
8. Free trial and subscription
- The subscription starts with a 14-day free trial. You subscribe in Google Play with a payment method; if you cancel before the trial ends, you won't be charged. The trial is offered under Google Play's rules — usually once.
- After that, the service runs on a per-family subscription. Payment, renewal and cancellation go through Google Play under its rules; refunds follow Google Play's rules and the law of your country.
- We may change prices and what the subscription includes, with advance notice in the app.
- If you are a consumer in the EU, your right to withdraw from a contract for digital services applies under Google Play's rules and the law of your country.
9. Data and privacy
How we handle data is described in the Privacy Policy. In short: voice messages, stickers, phone information and location are encrypted on family members' phones, and the server cannot read them. Audio, stickers and location stay on the server only until delivery and for no longer than 48 hours; the list of voice messages is kept on your phone for 30 days.
10. Limitation of liability
To the extent permitted by law:
- we are not liable for harm caused by a message or alert not being delivered, being delayed or being inaccurate, or by decisions made based on information in the app;
- we are not liable for indirect losses, lost profits or loss of data;
- our total liability to you is limited to the amount you paid for the service in the previous 12 months.
Nothing in these terms limits liability that cannot be limited by law, or consumer rights guaranteed to you by the law of your country.
11. Changes
We may change these terms. We will give advance notice of significant changes in the app. If you keep using the service after the changes take effect, you accept them.
12. Where the service is available
The subscription is purchased and paid for through Google Play wherever Google Play accepts payments. Your loved one uses the app free of charge as part of the family — including in countries where Google Play payments are unavailable. You are responsible for using the service in line with the law of the country you are in.
13. Governing law
These terms are governed by the law of [country — confirm with a lawyer]; disputes are heard by the courts of [city], unless the law of your country gives you the right to go to court where you live.
